Affiliate Program
Terms of Use
Prior to submitting your application, please note the following conditions set forth by The Independent Facilitator Training Academy:
- All referred purchases are attributed to the buyer's last-clicked affiliate link or code.
- The default referral window allows referrals from initial clicks within 365 days.
- You must have or create a PayPal account for payments.
- You must review the IFTA Affiliate Requirements
When we refer to "The Affiliate," we mean the entity you represent in accepting these Terms, or, if that does not apply, you individually. If you are accepting on behalf of your employer, your company, or another entity, you represent and warrant that (i) you have the full legal authority to bind your employer or such entity to these Terms; (ii) you have read and understand these Terms; and (iii) you agree to these Terms on behalf of the party you represent.
1. Compliance with Applicable Laws and Regulations: The Affiliate shall comply with all applicable federal, state, and local laws and regulations, including but not limited to the California Business and Professions Code, the California Online Privacy Protection Act, and the California Consumer Privacy Act, as well as any other applicable data protection and privacy laws.
2. Ethical Conduct and Best Interest of Clients: The Affiliate agrees to conduct their marketing and promotional activities ethically and professionally, always acting in the best interest of the clients they refer to the online school. The Affiliate shall not engage in deceptive, misleading, or manipulative practices or make false or unsubstantiated claims about the online school, its courses, or its services.
3. Payment Requirements and Tax Compliance: To receive commission payments, the Affiliate must meet the following requirements:
a. PayPal Account: Affiliates are required to provide a valid PayPal account by entering the relevant information in their affiliate dashboard. Payments will be made exclusively through PayPal, and the online school shall not be responsible for any fees or charges associated with the use of PayPal.
b. Payment Schedule: Commissions earned by the Affiliate will be paid on the first business day of each month, following an initial 30-day holding period. For example, commissions earned in January will be paid out on March 1st. The online school reserves the right to adjust the payment schedule in its sole discretion, with appropriate notice to the Affiliate.
c. Tax Compliance: The online school, or its designated accounting affiliates, will automatically collect W8 or W9 tax forms, as applicable, from Affiliates in accordance with relevant tax laws and regulations. Affiliates will be issued a 1099 form for any earnings made during the calendar year, as required by law. It is the Affiliate's responsibility to ensure that all information provided on their tax forms is accurate and up-to-date and promptly notify the online school of any changes to their tax status or information.
By participating in the affiliate program, the Affiliate agrees to comply with all requirements set forth in this section and acknowledges that failure to do so may result in delayed or forfeited commission payments.
4. Confidentiality and Data Protection: The Affiliate agrees to maintain the confidentiality of any client information they obtain in connection with their referral activities and to handle such information in compliance with all applicable data protection and privacy laws. The Affiliate shall not disclose, sell, or otherwise distribute any client information to third parties without the express written consent of the client and the online school.
5. Non-Disparagement: The Affiliate agrees not to engage in any activities or make any statements that may disparage or damage the reputation of the online school, its instructors, employees, or other affiliates.
6. Termination for Unethical Conduct: The online school reserves the right to terminate the Affiliate's participation in the affiliate program immediately and without prior notice if the Affiliate is found to have engaged in unethical conduct or breached any terms of this Agreement. The Affiliate shall forfeit any pending commissions or referral fees in such cases.
7. Non-Compete: During the term of this Agreement and for a period of [insert duration, e.g., 12 months] following the termination or expiration of this Agreement (the "Restricted Period"), the Affiliate agrees not to directly or indirectly, on their own behalf or on behalf of any other person or entity, engage in or participate in any business activities that directly compete with the online school. This includes but is not limited to promoting, marketing, or selling products or services substantially similar to the courses and services offered by the online school. The Affiliate further agrees not to solicit or attempt to solicit any clients, students, or customers of the online school to provide competing services during the Restricted Period and within the Restricted Territory. The parties acknowledge that the restrictions contained in this non-compete section are reasonable and necessary to protect the legitimate interests of the online school and that any violation of these restrictions would cause substantial harm to the online school.
8 No Spamming: Seriously. No one likes spam. We don't like spam. We're pretty sure you don't like your inbox cluttered with spam. You may not use the Teachable Platform or The Independent Facilitator Training Academy student email or comment section to engage in any activities that will result in sending spam to anyone on the Teachable Platform, including Teachable (and its employees), Creators, and Students.
9. Be Civil: We mean this. We understand not all Creator Content is for everyone. But the one thing we can all agree on is that when we use the Independent Facilitator Training Academy access or the Teachable Platform, we are going to be civil and respectful at all times.
10. No Exploitation: Affiliate will not use the Independent Facilitator Training Academy access or the Teachable Platform to try to gather personal information on anyone outside of the limited permissible uses for offering or accessing User Content.
11. No Impersonation: Imitation is the sincerest form of flattery, but not when it comes to representing that You are a part of the Independent Facilitator Training Academy access or the Teachable Platform. Affiliates will not impersonate anyone on the Independent Facilitator Training Academy access or the Teachable Platform (and its employees), Creators, and Students.
12. Accurate Representation of the Online School: The Affiliate shall represent the online school, its courses, and services accurately, fairly, and truthfully. The Affiliate is prohibited from making any misrepresentations or false statements about the online school or its offerings. All promotional materials provided by the online school for Affiliate use must be used as provided and not altered without prior written consent from the online school.
13 Feedback: You may choose, or we may invite Affiliates to submit suggestions, recommendations, enhancement requests, or other Feedback about the Independent Facilitator Training Academy content, templates, topics, etc. By submitting any Feedback, Affiliates agree that such Feedback is gratuitous, unsolicited, and without restriction. You grant us a royalty-free, worldwide, transferable, sublicensable, irrevocable, perpetual license to use or incorporate Feedback into the Independent Facilitator Training Academy modules, templates, content, services, and/or the Academy available content. We actively review Feedback for new ideas. If Affiliates wish to preserve any interest You might have in your Feedback, Affiliates should not provide them or send them to us.
14. The Independent Facilitator Training Academy may modify, terminate, or refuse to provide Affiliate Services at any time for any reason, without notice, and at any time for any reason, solely at the Independent Facilitator Training Academy's discretion. Any other section of these Terms does not modify this right. The Independent Facilitator Training Academy reserves the right to remove Affiliates without warning if You violate any of the provisions of these Terms.
